It’s been a year since hemp was legalized across the United States by the passing of the 2018 Farm Bill and in that year the market for CBD has exploded and the U.S. Food and Drug Administration (FDA) is struggling to catch up with this growing market. As a result of the popularity of CBD and the lack of information around CBD, there is growing concern around quality and safety in the production of CBD as well as inaccuracy around the marketing of CBD products. As the FDA begins to adjust to the boom of CBD and address these concerns, many companies have received CBD FDA warning letters due to inaccuracies and making false claims about the properties of CBD.

What The FDA Says
With historically very little research around cannabinoids, the FDA is scrambling to catch up to the boom of hemp and CBD products and answer questions about the science, safety, and quality of products containing CBD. According to the FDA, there is simply not enough data on the effects of CBD to make any assertions or claims around its properties or benefits, however, they are working to start answering these questions.
Scientific research around CBD in the past was almost entirely limited to drug trials around its efficacy to treat certain types of epilepsy, and the only FDA approved CBD product is the prescription drug Epidiolex for the treatment of two forms of epilepsy. Apart from that, the FDA has not approved any other usage of CBD – be it medical or as a dietary supplement.
What we do know, is that CBD has the potential to affect the body enough that it is important to consult with a physician should you choose to take it on a regular basis. One of the big unknowns around CBD is its long term effects when taken daily for a sustained period of time, and there does not exist sufficient research to establish potential negative side effects.
Why Do We Know So Little About CBD?
The reason we know so little about CBD is due to its psychoactive cousin THC and the Controlled Substances Act of 1970. Cannabis was a highly misunderstood substance that began to be associated with narcotics in the early 20th century, dragging hemp along with it.
The CSA designated both the cannabis plant and hemp as “Marijuana” and a Schedule 1 drug. This meant that cannabis and hemp were considered a substance equivalent to LSD and furthermore, that they were considered to have no value for medical use. This designation meant that both plants became highly illegal which prohibited the research and production of hemp and ignored any potential therapeutic use of cannabinoids in medicine.
The 2018 Farm Bill, which passed December 2018 and removed hemp from the designation of “Marijuana” effectively legalizing it across the United States for the first time in nearly fifty years.
